1. About TheDispatcher.us

TheDispatcher.us ("Company," "we," "us," or "our") is a web-based platform that allows motor carriers and owner-operators ("Carriers") to submit and read reviews of freight brokers operating in the United States. Our mission is to promote transparency and accountability in the freight industry.

2. Eligibility

You must be at least 18 years of age and hold a valid Motor Carrier (MC) or DOT number issued by the FMCSA to register as a Carrier and submit reviews. By using the Service, you confirm that you meet these requirements. We reserve the right to verify MC/DOT numbers against the FMCSA database and to suspend accounts that provide false information.

Freight brokers ("Brokers") may access the platform to read reviews and respond to disputes without a Carrier account, subject to all applicable provisions of these Terms.

3. Account Registration

To access full platform features, you must create an account. You agree to:

• Provide accurate, current, and complete information, including a valid MC/DOT number.
• Keep your login credentials confidential. You are responsible for all activity under your account.
• Notify us immediately at support@thedispatcher.us if you suspect unauthorized access to your account.
• Not create accounts using false identities or fraudulent MC/DOT numbers.

4. Free Trial and Subscription Plans

New registered Carriers receive a 30-day free trial with access to premium features. After the trial expires, continued premium access requires a paid subscription. Subscription fees are processed through Paddle, our authorized Merchant of Record, at the pricing listed on our website.

• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel at any time through your account settings. Access continues until the end of the current billing period.
• Free-tier users retain the ability to submit reviews and view limited platform data.

5. User Reviews and Content

All reviews, ratings, comments, and uploaded files ("Content") submitted by users are the sole responsibility of the submitting user. By submitting Content, you represent and warrant that:

• The Content is truthful and based entirely on your own firsthand experience with the identified broker.
• You have the legal right to share any documents or files uploaded as supporting evidence.
• The Content does not violate any applicable law, including laws on defamation, trade secrets, copyright, or privacy.
• The Content does not contain false statements of fact, personal attacks unrelated to business conduct, or information obtained unlawfully.

By submitting Content, you grant TheDispatcher.us a non-exclusive, royalty-free, worldwide license to display, distribute, and use your Content in connection with the operation of the platform.

6. Review System Rules

The platform uses the following rating methodology:

• Rating Score: Calculated as (Positive Reviews / Total Reviews) x 100. Starts at 100% for brokers with no reviews.
• Green (≥75%): Brokers with a consistently positive track record.
• Yellow (50–74%): Brokers with a mixed track record — proceed with caution.
• Red (<50%): Brokers with a predominantly negative track record.
• Comments: Limited to 100 characters — concise and direct.
• Document uploads: Required with each review. Only visible to the submitting Carrier and platform administrators.

7. Prohibited Conduct

You agree not to:

• Submit false, fabricated, or defamatory reviews.
• Submit reviews on behalf of competitors or as part of a coordinated campaign to harm a broker's reputation.
• Attempt to manipulate ratings or game the review system.
• Use the platform to harass, threaten, or intimidate any person or business.
• Scrape, copy, or redistribute platform content without our written consent.
• Attempt to gain unauthorized access to our systems or another user's account.
• Use the platform in any manner that violates federal or state laws governing the transportation industry.

Violations may result in immediate account suspension, content removal, and referral to law enforcement where applicable.

8. Broker Right of Reply

When a review is submitted, the identified broker receives an automated email notification with a secure, single-use link to submit a written response and supporting documentation within 30 days. After that window closes, no further response is accepted for that review.

Broker responses are displayed alongside the original review. TheDispatcher.us does not act as an arbiter between Carriers and Brokers. We reserve the right — but not the obligation — to remove Content that is clearly defamatory or unlawful following a properly submitted dispute.

9. Uploaded Documents

Documents uploaded by Carriers (rate confirmations, load sheets, etc.) are stored securely. They are visible only to the submitting Carrier and platform administrators. Documents are never shared with Brokers or third parties without the Carrier's explicit consent, except where required by law.

10. Content Moderation

We reserve the right — but not the obligation — to review, edit, or remove any Content that we determine, in our sole discretion, to violate these Terms, applicable law, or our community standards. We are not liable for any failure to remove or delay in removing harmful Content.

11. Intellectual Property

All platform design, software, trademarks, logos, and original content created by TheDispatcher.us are our exclusive property. User-submitted Content remains the intellectual property of the submitting user, subject to the license granted in Section 5.

12. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. REVIEWS AND RATINGS REFLECT THE OPINIONS OF INDIVIDUAL USERS AND DO NOT CONSTITUTE ENDORSEMENTS OR FACTUAL FINDINGS BY THEDISPATCHER.US.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THEDISPATCHER.US AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless TheDispatcher.us, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the platform; (b) Content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights.

15. Governing Law

These Terms are governed by the laws of the United States. Disputes shall first be submitted to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA).

16. Modifications

We may update these Terms at any time. Material changes will be communicated by email to registered users and reflected on this page with an updated date. Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.

17. Termination

We may suspend or terminate your account at any time for conduct that violates these Terms or is harmful to other users, our business, or third parties. Sections 5, 11, 12, 13, 14, and 15 survive any termination.
